Terms of sale

The plain terms for buying a painting, a print or a commission from me. If anything here is unclear, email me at [email protected] before you order.

Who you’re buying from

Mark James Lucas, a painter in Oliver, British Columbia, Canada. I run this site and the shop myself.

Prices and payment

Prices are in the currency shown at checkout. Sales tax (GST, and PST or HST where it applies) is added at checkout when the law requires it. Payment is by card through Stripe; I never see or store your card number.

An order is confirmed when payment goes through and you get the confirmation email. If a painting sells twice at the same moment, the second buyer gets a full refund straight away.

Original paintings

Each original is one of a kind, oil on panel unless the listing says otherwise, and ships unframed unless the listing says it comes framed. Photos are taken in daylight, but screens differ, so colours can look a little different in person. Original paintings ship from Oliver within seven business days of your order (see shipping and returns).

Prints

Prints are giclée prints made to order for you by my print partner, on fine art paper or canvas, framed or unframed as you choose. They’re printed after you order, usually within three to seven business days, then shipped. Every print is checked against my own proof, but a print on paper or canvas won’t match a backlit screen exactly.

Commissions

Before I start a commission we agree, by email, the place or sketch, the size, the price, any deposit and a rough timeline. A commission is painted for you, so once the painting is underway the deposit isn’t refundable. If you don’t love the finished painting, tell me: I’d rather fix it than have you live with something you don’t want.

Copyright

I keep the copyright in every painting, photo, film and piece of writing on this site. Buying an original or a print gives you the object, not the right to reproduce it. You’re welcome to share photos of it hanging in your home; please tag me.

Using this site

Please don’t copy the paintings, photos or films for commercial use, or scrape the site. The site is provided as it is; I do my best to keep it accurate and online.

The law

These terms are governed by the laws of British Columbia and of Canada. Nothing here takes away rights you have as a consumer where you live.

Once a month

Letters from
the road.

New paintings, where I’m painting next, and the first look at new prints. One email a month, nothing else.
